Purpose of Activity/Assignment: to assess the impact of the law 100/2024 on the relevant normative framework for the protection and promotion of child rights and provide clear recommendations for needed adjustments and/or development of secondary legislation (methodologies, guidelines, protocols, etc.)

Scope of Work:
Based on accumulated experience and evidence, as a results of concentrated efforts and political commitment for a paradigm shift in the social assistance system reform, a new legislation package was approved in April 2024 – Law 100 for the modification and completion of some normative acts in the field of social assistance, as well as for the completion of Law no. 78/2014 regarding the regulation of voluntarism in Romania and for the amendment of Law no. 272/2004 on the protection and promotion of the rights of the Child. This new package of legislation includes specific amendments of several laws relevant for social assistance: Law 197/2012 regarding quality assurance in the field of social services; GEO 82/2016 for the approval of the Special Statute of the specific public function of social inspector; Social assistance law 292/2011; Law 17/2000 on social assistance for the elderly; Law 78/2014 on volunteering, and promote changes affecting planning, organization, functioning, financing, monitoring and evaluation of social services at local level. For effective implementation of these new provisions, specific secondary legislation (ie. standards, methodologies, guidelines, etc.) are to be developed in the next weeks and months. In fact, the Ministry of Labor and Social Solidarity and the Ministry of Family, Youth and Equal Opportunities need to prepare the appropriate amendments and additions to the normative acts in force in the field of social assistance, within 2 years from the date of entry into force of the provisions of the Law 100/2024.
 
While work on some specific secondary legislation already started, there is a need to better understand and address as soon as possible, the impact this new legislation package has on special laws such as the ones for promotion and protection of child rights, for the rights of people with disabilities, for social assistance for elderly, etc.
 
The scope of this consultancy is to perform a legal analysis with regards to the impact of the law 100/2024, particularly of the Law 292/2011 on social assistance and Law 197/2012 on quality of social services, but also of other laws part of the package if appreciated relevant, on the special law and extended normative framework relevant for the protection and promotion of child rights. This analysis not only needs to spot and explain impact, including possible consequences, but also develop and prioritise recommendations with regards to development and/or amendment of secondary legislation (methodologies, guidelines, protocols, etc.).

To qualify as an advocate for every child you will have… 

  • An advanced university degree (Masters) in law, Public Administration, Public Policy.

Knowledge/Expertise/Skills required:

ꟷAt least 7 years of experience working in the development (including legislative technique) and analysis of national policies and legislation
ꟷPrevious experience in contributing to the development of legislation
  • in finance, public administration – 1 person and
  • in social services (including child/social protection, health and education) – 1 person
ꟷPrevious experience in working with various structures of the Government and/or the Parliament of Romania

Individuals engaged under a consultancy or individual contract will not be considered “staff members” under the Staff Regulations and Rules of the United Nations and UNICEF’s policies and procedures, and will not be entitled to benefits provided therein (such as leave entitlements and medical insurance coverage). Their conditions of service will be governed by their contract and the General Conditions of Contracts for the Services of Consultants and Individual Contractors. Consultants and individual contractors are responsible for determining their tax liabilities and for the payment of any taxes and/or duties, in accordance with local or other applicable laws. 

The selected candidate is solely responsible to ensure that the visa (applicable) and health insurance required to perform the duties of the contract are valid for the entire period of the contract. Selected candidates are subject to confirmation of fully vaccinated status against SARS-CoV-2 (Covid-19) with a World Health Organization (WHO)-endorsed vaccine, which must be met prior to taking up the assignment. It does not apply to consultants who will work remotely and are not expected to work on or visit UNICEF premises, programme delivery locations or directly interact with communities UNICEF works with, nor to travel to perform functions for UNICEF for the duration of their consultancy contracts.
